In the Philippines, it's easy to transfer car ownership if the owner is alive. If the owner is selling the car, he'll just sign a Deed of Sale, notarize it, and let the buyer go to LTO, submit LTO Transfer of Ownership Requirements with correct Vehicle Ownership Details, and pay the fees.
If the car has no violation, the transfer of ownership can be done within a few hours.
But if the car owner has passed away, the transfer process is more difficult and takes more than a month.
Here is a list of LTO's List of Requirements to Transfer Ownership of a Car After Death:
- Original Certificate of Registration (CR) and latest Official Receipt (OR) of Motor Vehicle User's Charge (MVUC) and other fees
- Deed of Extra Judicial Settlement of Estate in case the deceased is survived by 2 or more heirs or Affidavit of Sole Adjudication in case the deceased is survived by only 1 heir
- Proof of Publication of the Deed in any newspaper of general circulation 3 times for 3 consecutive weeks
- Death Certificate, Marriage Contract, and/or Birth Certificate, as applicable
- Original PNP/HPG Motor Vehicle Clearance Certificate and Macro-etching Report
- Motor Vehicle Inspection Report (MVIR)
- Appropriate Insurance Certificate of Cover (COC)
- Certificate of Emission Compliance (CEC)
- Photocopy of IDs of all persons involved (one ID on one bond paper with 3 signatures)
- Authorization letter from the new owner, authorizing the person who will process the transfer (just in case iba ang maglalakad ng transfer)
- Photocopy of ID of the person processing the transfer (just in case hindi yong new owner ang maglalakad)
- Photocopy of death certificate, marriage contract, and/or birth certificate, as applicable
- XXX Proof of Recording of the Deed in the Registry of Deeds of the locality where the deceased resided (Nakalista ito sa List of Requirements sa LTO website, pero hindi na ito kelangan; required lang ito sa mortgage chattel at real estate property)

Reminder!!! Kapag gusto niong magsabay na ang transfer at registration renewal, buy the insurance certificate only after the transfer of ownership has been done. Para yong insurance ay under the name of the new owner.

What is Requirement No. 3? Proof of Publication of the Deed of Extrajudicial Settlement of Estate
Ito ay affidavit or certificate galing sa newspaper publisher na nagpapatunay na ang iyong Deed of Extrajudicial Settlement of Estate ay na-publish sa kanila 3 times (one day per week for 3 consecutive weeks). Meron akong sample Deed dito.
Gawin mo yong Deed of Extrajudicial Settlement mo, then pa-notarize mo, then maghanap ka ng newspaper of general circulation na magpa-publish ng Deed mo. Dapat ma-publish 3 times (one day per week sa 3 na magkakasunod na weeks).
You won't publish the whole Deed. It will be too expensive. You will just publish important information. Usually, alam na ng publisher yong mga important details to be published, like the type and brand of vehicle, name of registered owner (yong deceased) and plate number. It will be published in the Classified Ads section. Ask for the cheapest column ad.
Since this is a car ownership transfer, the vehicle brand, model, plate number and deceased owner's name must be included. Kasi titingnan ng LTO kung mag-match ang mga information.

What does the newspaper need in order to publish your Deed?
1. A copy of your Deed of Extrajudicial Settlement of Estate. Should be Notarized.
2. Your payment for the publication.
Find a newspaper that charges the lowest rate. It must be a newspaper of general circulation, which means ito ay printed publication, merong subscribers, hindi siya Internet-only newspaper, at hindi siya para sa isang grupo lang. Hindi puede ang church newspaper na para sa isang church lang, or school newspaper na para sa school lang, or association newspaper na para sa asosasyon lang.
Kung hindi kayo makapunta sa newspaper office para ma-pick-up yong Proof of Publication, ask if the publisher allows pick-up of the document by Grab or LalaMove, and ask if you need to call before the rider picks up the Proof.

What are the other kinds of Deeds related to Settlement of Estate?
Yong title na "Deed of Extra Judicial Settlement of Estate" ay dudugtungan ng "With Absolute Deed of Sale" kung isasabay na sa Settlement yong pagbenta ng mana.
Yong iba naman "With Donation" kung ipapamigay yong mana sa iba.
Yong iba "With Waiver of Rights" kung isa o iba pa ay hindi na sasali sa hatian at iwawaksi na nila ang kanilang karapatang magmana sa property o properties.
